Former employee claims home improvement company violated labor laws

ORLANDO — A former employee is suing Florida Home-Improvement Associates Inc. and David Batson, a home improvement company, citing alleged violation of the Fair Labor Standards Act (FLSA).

Bianca M. Rodriguez Ortiz filed a complaint on May 30 in the Orange County Circuit Court against the defendants alleging that they failed to compensate employees proper wages and benefits.

According to the complaint, the plaintiff alleges that since June 26, 2016, she has suffered lost earnings from the defendants' wrongful practice of denying her of her earned wages for all overtime hours worked and for all hours worked “off the clock,” not receiving proper meal and rest breaks, and being subjected to wrongful termination of her employment for having a disability or perceived disability. 

The plaintiff holds Florida Home-Improvement Associates Inc. and David Batson responsible because they allegedly failed to maintain and keep accurate time records, failed to provide proper wages for all hours worked and terminated her employment in bad faith without reasonable grounds.

The plaintiff requests a trial by jury and seeks judgment against defendants for lost wages, compensatory damages, interest, attorney's fees, costs and further relief as the court deems just. She is represented by Scott C. Adams and N. Ryan Labar of Labar & Adams PA in Orlando.
