Windmere property owners accuse contractors of home construction deficiencies

ORLANDO — Two Windmere property owners are suing a contractor, alleging negligence and vicarious liability due to home construction deficiencies.

Kyoko Mamitsuka and Kwang Chung filed a complaint May 23 in Orange County Circuit Court  against Ahston Orlando Residential LLC, alleging the defendant failed to adequately construct a home design properly and violated local and state building codes.

According to the complaint, in 2008 Mamitsuka's and Chung's property at 12731 Holdenbury Lane in Windmere was built and conveyed by special warranty deed by Ashton Orlando. Subsequent to construction and upon inspection, the suit says, certain design and construction deficiencies were observed, including an inadequately and improperly installed stucco system. The plaintiffs allege this resulted in numerous defects and deficiencies in the various systems and components of the property, including violations of local and state building codes. 

The plaintiffs allege Ahston Orlando Residential negligently violated the Florida Building Codes Act, including applicable ASTM Standards.

Mamitsuka and Chung seek trial by jury, damages in excess of $15,000, exclusive of interest, costs, attorney fees and all other relief the court deems just and appropriate. They are represented by attorneys Neil P. O'Brien, Wil H. Florin, Luca G. Esposito and Kavon P. Smith of Florin Roebig PA in Palm Harbor.
