Former worker alleges premature termination of contract

ORLANDO — A Palm Beach County man is suing his former employer, alleging breach of contract and wrongful termination.

Carlos M. Linares filed a complaint May 23 in Orange County Circuit Court against Optimal Green Solutions, LLC alleging the defendant breached its contractual obligation by prematurely terminating Linares' employment and owes him $98,000.

According to the complaint, between Dec. 7, 2017 and Jan. 11, 2018, Linares entered in an independent contractor agreement with Optimal as an employee with a fee of $2,000 per week and he began performing services in accordance with the contract. Despite performing satisfactorily and without complaints and warnings, the suit says, Optimal terminated Linares' employment with 49 weeks remaining on the term of the contract.

The plaintiff alleges Optimal Green Solutions breached its contractual obligation by prematurely terminating Linares' employment under the agreement and is liable to pay the remaining salary for the 12-month period.

Linares seeks trial by jury, damages of $98,000, plus attorney fees, court costs, interest and all other relief the court deems just and proper. He is represented by attorney Frank M. Malatesta of Malatesta Law Office in Venice.
