Customer alleges Clearwater bar's negligence led to fight

CLEARWATER — A Clearwater man is suing a local bar and business owner, alleging negligence led to the plaintiff being struck by another customer.

Spencer Auguste filed a complaint May 22 in the Pinellas Circuit Court against Razzel's Inc., doing business as Razzel's Bar, and Bledi Bejo, alleging Razzel's failed to follow applicable safety guidelines and regulations.

According to the complaint, on April 30, 2016, Aususte was at Razzel's, 2794 Gulf to Bay Blvd., Clearwater.. Auguste said he tried to calm down a beligerent Bejo who had had too much to drink.  

The suit says Bejo struck and kicked Auguste without warning, provocation or legal justification. As a result of the incident, the suit says, the plaintiff fell over a concrete barrier and sustained bodily injuries aggravation of a pre-existing condition, pain and suffering, disability, physical impairment, mental anguish, loss of enjoyment of life, and medical expenses. 

The plaintiff alleges Razzel's Bar failed to provide adequate security for patrons, and failed to control and adequately supervise the premises.

Auguste seeks trial by jury, damages of more than $15,000, post-judgment interest and costs. He is represented by attorney Robert E. Heyman of Heyman Law Firm PA in St. Petersburg.
