ORLANDO — A Winter Garden property owner is suing an insurer, alleging failure to adequately indemnify a covered property loss.
Alexander Rios Perez filed a complaint May 23 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging failure and refusal to adequately indemnify a loss for hurricane damage.
According to the complaint,on Sept. 10, 2017, Perez's property at 7933 Iceland Gull St., Winter Garden, suffered a covered loss due to wind, wind-driven rain and/or hail from Hurricane Irma. The suit says the insurance policy was in full force and effect; and all conditions precedent were complied with.
Perez says American Integrity was duly informed of the loss, acknowledged the claim and inspected the property. However, the suit alleges, the defendant has failed to adequately indemnify Perez for the loss, causing him to suffer more damages and incurring substantial expenses for repairs.
The plaintiff alleges American Integrity Insurance of Florida has failed and refused to adequately indemnify full coverage for the loss, which is due and owing under the policy.
Perez seeks trial by jury, damages that exceed $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Louis A. Gonzalez of Vargas Gonzalez Hevia Baldwin, LLP in Orlando.
