Customer accuses auto auction company of negligence

ORLANDO — A Brevard County customer is suing an Orlando auto auction company and its manager, alleging insufficient measures were taken to prevent injuries.

Allan Comrie filed a complaint May 23 in Orange County Circuit Court against Manheim Marketing Inc. and Butch Herdegen, alleging failure to provide a safe environment and maintain its premises from hazardous conditions.

According to the complaint, on March 22, 2016, Comrie was at the defendant's auto auction, 9800 Bachman Road, Orlando. The suit says Comrie was struck by a motor vehicle that was being moved by an employee.

Comrie says he sustained bodily injuries, disability, disfigurement, permanent and significant scarring, mental anguish, expense of hospitalization, medical and nursing care and treatment, and loss of earnings. 

The plaintiff alleges Manheim Marketing and Herdegen negligently failed to provide a reasonably safe environment for its customers and failed to exercise reasonable care in maintaining its premises from dangerous and foreseeable conditions.

Comrie seeks trial by jury, damages in excess of $15,000, exclusive of court costs, interest, attorney fees and all further relief the court deems necessary and appropriate. He is represented by attorney Grant R. Gillenwater of Morgan and Morgan PA in Melbourne.
