Alabama driver allegedly caused Palm Harbor accident resulting in severe injuries

CLEARWATER — A Florida resident is suing an Alabama driver for severe injuries allegedly resulting from a collision.

David Mattingly filed a complaint May 21 in the 6th Judicial Circuit of Florida - Pinellas County against Ashley S. Franklin alleging that the defendant negligently operated and maintained a motor vehicle.

According to the complaint, the plaintiff alleges that on May 19, 2017, he was driving at McMullen Booth Road and Tampa Road in Palm Harbor when his vehicle was allegedly rear-ended by the defendant, causing severe and permanent injuries, pain, mental and emotional anguish, disability, damage to property, and medical expenses. 

The plaintiff holds  Franklin responsible because the defendant allegedly negligently and carelessly operated a motor vehicle resulting in a collision that caused harm to other motorists.

The plaintiff requests a trial by jury; and seeks damages exceeding $15,000, exclusive of costs, interest, attorney's fees, and such other relief as the court deems necessary and appropriate. He is represented by Scott M. McPherson of Scott M. McPherson, PA in New Port Richey.
