Property owners say Universal Property and Casualty denied coverage for hurricane damage

ORLANDO — Property owners are suing Universal Property and Casualty Insurance Co. for breach of contract after the company refused to pay for hurricane-related damage to their properties.

Winona Rhodes and Senny Rhodes filed a complaint on May 16 in the Orange Circuit Court against Universal Property and Casualty, alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, on Sept. 11, 2017, the Rhodes suffered storm water damage to their insured home, but the defendant refused to pay the claim despite plaintiffs' performance of all conditions precedent to coverage. 

The plaintiffs hold Universal Property and Casualty Insurance responsible because the defendant allegedly failed to timely evaluate and pay all benefits owed to them and failed to comply with the terms of the insurance policy.

The plaintiffs request a trial by jury; and seek a judgment against defendants for damages, interest, costs and attorney's fees. They are represented by David R. Heil of David R. Heil PA in Winter Park.
