Ashton Woods Homes' work allegedly brought mold and mildew to couple's property

ORLANDO — Contractor Ashton Orlando Residential LLC, which does business as Ashton Woods Homes and Residential Warranty Co. LLC, has been named as the defendant in a lawsuit filed by property owners alleging breach of contract, breach of warranty, negligence and unjust enrichment.

Jamie and Scott Rogaliner filed a complaint on May 16 in the Orange Circuit Court, alleging that Ashton breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs' personal property was damaged and their health threatened on March 15, 2014 as a result of the defective construction of a residential structure by the defendants on the plaintiffs' property. The complaint alleged that the damage included the growth of mold and mildew and other latent defects that the defendants refused to repair. 

The plaintiffs said they hold Ashton responsible because the defendants allegedly have affected the structural integrity and value of their property, and refused to remedy the defects on the property that allegedly resulted from Ashton's poor workmanship.

The plaintiffs request a trial by jury and seek a judgment against the defendant for damages, interest, attorney's fees, court costs and other relief as the court deems just. They are represented by Robert A. Lash of Moody, Salzman, Lash & Locigno in Gainesville.
