Woman alleges Winter Park property owners failed to warn of wire that caused fall

ORLANDO – A woman alleges she was caused to fall while walking in front of a Winter Park property because of a wire running between the yard and the berm.

Sharon and Joseph Sutera filed a complaint on May 16 in the Orange Circuit Court against Gary Kelser and Cindy Kelser alleging negligence.

According to the complaint, the plaintiffs allege that on Jan. 12, 2017, as Sharon Sutera was making her way down Genius Drive and crossed in front of defendants' home, she tripped on a wire that was protruding above the sidewalk that powered an invisible fence pet security system and fell. She alleges she was injured as a result.

The plaintiffs hold Gary Kelser and Cindy Kelser responsible because the defendants allegedly failed to warn pedestrians walking in front of their home of the dangers in the sidewalk and failed to inspect, maintain and remedy the dangerous condition on their property.

The plaintiffs seek judgment against defendants for an amount of more than $15,000, exclusive of costs, interest, and any applicable attorneys' fees. They are represented by Kim Michael Cullen of Cullen & Hemphill PLC in Winter Park.
