Shopper claims he tripped and fell over unmarked barricade in Orlando Lowe's store

ORLANDO — A shopper is suing a home improvement store, citing alleged insufficient measures were taken to prevent injuries.

Theodore Huber filed a complaint May 15 in the 9th Judicial Circuit Court of Florida - Orange County against Lowe's Home Centers LLC alleging that the defendant negligently failed to exercise reasonable care in maintaining its premises from dangerous conditions.

According to the complaint, the plaintiff alleges that on Sept. 20, 2017 he was at the defendant's premises at 8700 W. Colonial Drive in Orange County when an unmarked barricade caused him to trip and fall, resulting in bodily injuries, physical impairment, medical expenses and inconvenience.

The plaintiff holds Lowe's responsible because the defendant allegedly negligently failed to maintain and/or adequately maintain its premises from foreseeable dangerous conditions for customers and visitors.

The plaintiff requests a trial by jury; and seeks damages exceeding $15,000, together with costs, interest, attorney's fees, and other such relief the court deems just and proper. He is represented by Christopher Genca Fontana of Law Offices of Fontana & Associates, PA in Orlando.
