Estate of family killed in Brevard County crash says defective Goodyear tires to blame

ORLANDO — Florida residents are suing The Goodyear Tire & Rubber Company and Joseph and Karina Prosser, alleging their negligence resulted in multiple wrongful deaths.

Tanya Vega, personal representative of the estates of Amunya Cruz, Jazmin Cruz, Niasha Cruz and Nadia Cruz, filed a complaint May 14 in the 9th Judicial Circuit Court of Florida - Orange County against Goodyear and the Prossers,  alleging that the defendants failed to exercise reasonable care in selling defective tires. 

According to the complaint, the plaintiffs allege that on May 30, 2016 the Cruz family was riding in a 2006 Dodge Durango, purchased from the Prossers, traveling southbound on State Road 406 near Mile Marker No. 2 in Brevard County when a defective Goodyear tire separated from the vehicle and caused a crash, which resulted in their deaths. 

As a result, their heirs have suffered medical and funeral expenses, emotional grief, mental distress, and loss of support. 

The plaintiff holds Goodyear and the Prossers responsible because they allegedly negligently failed to exercise reasonable care on the selling and inspecting of defective tires that may be hazardous and fatal to buyers.

The plaintiff requests a trial by jury; and seek all damages exceeding $15,000, plus costs, interest, attorney's fees, and such other relief the court may deem just and proper. She is represented by R. Frank Melton, II of Newsome Melton in Orlando and Derek Merman of The Merman Law Firm, PC in Houston.
