Brick City Southern Kitchen allegedly bailed on rental agreement before deal was done

ORLANDO — A rental services company is suing Mojo Brick City Barbeque LLC, doing business as Brick City Southern Kitchen, alleging alleged breach of contract.

ALSCO Inc. filed a complaint May 15 in the Orange Circuit Court alleging that the Ocala restaurant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Sept. 20, 2016 Mojo Brick City Barbeque entered into a rental agreement with ALSCO for various restaurant supplies. On Feb. 8, however, ALSCO was informed that the restaurant was terminating the agreement. As a result, ALSCO alleges that it sustained monetary damages, as a result of the alleged unlawful conduct of the defendant to cancel the agreement before its scheduled termination date and failure to pay plaintiff for the product buy-out provision in the agreement. 

The plaintiff holds Mojo Brick City Barbeque responsible because the defendant allegedly failed to perform an obligation under the agreement and pay plaintiff for rental services as agreed.

The plaintiff requests a trial by jury; and seeks a judgment against the defendant for liquidated and actual damages, interest, costs and attorney's fees, and other relief as the court deems just. It is represented by James D'Loughy of Advisorlaw PLLC in Palm Beach Gardens.
