Collins Asset says Miami property owner hasn't paid $114,552 mortgage

ORLANDO — A Texas-based company is suing a Florida resident for unjust enrichment due to unpaid debt.

Collins Asset Group LLC filed a complaint May 15 in the 9th Judicial Circuit Court of Florida - Orange County against Ramon Preval alleging that the Florida resident failed to pay a $114,552.19 debt.

According to the complaint, the plaintiff alleges that on Feb. 2, 2017 it issued a promissory note to Preval for $120,000 related to the property at 1200 Brickell Bay Drive in Miami. After reducing the balance due and giving ample time, Preval allegedly still failed to pay the default amount of $114,552.19, resulting in damages and costs for them.

The plaintiff holds Preval responsible because the defendant allegedly breached his duty by failing to pay the default amount and has benefited from the loan proceeds but failed to comply with the required payments in accordance with the promissory note.

The plaintiff requests a trial by jury; and seeks the principal due of $114,552.19, plus interest, court costs, attorney's fees, and such other relief the court may deem just and proper. They are represented by Maribel Diaz and Stacey Gladding of Behar, Gutt & Glazer, PA in Fort Lauderdale.
