ORLANDO — An Orlando property owner is suing Florida Peninsula Insurance Company, alleging breach of contract.
Jose Arreseigor filed a complaint on May 15, in the Orange Circuit Court against Florida Peninsula Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that on Sep. 10, 2017, while his home's insurance policy was in full force and effect, it sustained a covered loss. However, despite efforts of the plaintiff to comply with all post-loss obligations to recover under the policy, the defendant denied the claim for benefits.
The plaintiff holds Florida Peninsula Insurance Company responsible because the defendant allegedly failed to perform under the policy and fully value plaintiff’s losses, and failed to fully pay for all of plaintiff’s losses.
The plaintiff requests a trial by jury; and seeks a judgment against the defendant for the plaintiff’s losses with interest on any overdue payments, attorney's fees and costs. He is represented by James J. Dye of Morgan & Morgan PA in Orlando.
