ORLANDO — A homestead property owner is suing an insurer, alleging breach of contract related to hurricane and water damages.
Maria Reyes filed a complaint on May 9 in the 9th Judicial Circuit Court of Florida-Orange County against American Traditions Insurance Company alleging that the defendant failed to initially pay at least the full amount of the actual cash value in the policy.
According to the complaint, the plaintiff alleges that on Sept. 10, 2017, her homestead property at 8129 Strada Drive in Orlando suffered a covered loss due to hurricane wind damage and immediate water damage to the property while the policy was in full force and effect and all conditions precedent were complied with. Despite defendant acknowledging the claim, Reyes allegedly didn't get the full amount for the covered loss.
As a result, Reyes sustained damages in the amount of the insurance benefits that were due and owing.
The plaintiff holds American Traditions Insurance Company responsible because the defendant allegedly failed to initially pay and refused to pay at least the full amount of the actual cash value in the policy.
The plaintiff requests a trial by jury and seeks damages in excess of $15,000, plus interest, costs, attorney's fees and such other relief the court may deem just and proper. She is represented by David D. Gongora of Law Office of David D. Gongora, PA in Orlando.
