Dr. P. Phillips Hospital accused of botching robotic surgery

ORLANDO — A couple is suing Orlando Health Inc., doing business as Dr. P. Phillips Hospital, alleging loss of consortium, negligence, and vicarious liability.

Robert Ortiz and Carolyn Ortiz filed a complaint May 15 in the Orange Circuit Court against Orlando Health,  alleging that the health care facility failed to provide services that met professional standards of quality.

According to the complaint, the plaintiffs allege that on Dec. 14, 2015, Robert Ortiz lost a massive amount of blood and suffered from a hypoxic brain injury as the result of the negligence by the defendants deviating from the appropriate standard of care during a robotic surgery.

The plaintiffs hold the health care provider responsible because the defendant allegedly failed to closely monitor and train its medical staff, and failed its duty to ensure that its staff could safely perform advanced robotic surgery.

The plaintiffs request a trial by jury; and seek a judgment against the defendant for damages in excess of $15,000, plus costs. They are represented by Andrew J. Wozniak of Greco & Wozniak PA in Tampa.
