Florida resident sues apartment owner/operator over slip-and-fall injury

CLEARWATER — A Florida resident is suing an apartment owner/operator for alleged negligence, claiming insufficient measures were taken to prevent injuries.

Kevin Barney filed a complaint May 9 in the 6th Judicial Circuit of Florida-Pinellas County against Pacifica San Diego Management d/b/a Alta Mar at Broadwater Apartments alleging that the defendant failed to maintain or adequately maintain the safety of its premises.

According to the complaint, the plaintiff alleges that on June 3, 2016, he was a visitor and lawfully walking along the sidewalk on the property located at 3901 38th Avenue S., St. Petersburg, which was owned by the defendant, when his foot slipped or stepped off the sidewalk into a deep hole around the pool area. 

As a result, he suffered serious physical injuries, mental anguish and incurred medical expenses for treatment. 

The plaintiff holds Alta Mar at Broadwater Apartments responsible because the defendant allegedly failed to maintain or adequately maintain the area in and around the sidewalk area by the pool by allowing a hole to remain next to the sidewalk area, creating a hazardous environment for tenants and visitors alike.

The plaintiff requests a trial by jury and seeks damages in excess of $15,000, exclusive of costs, interest, attorney's fees and other further relief the court may deem just and proper. He is represented by Adam Brum of Morgan & Morgan, Tampa, PA in St. Petersburg.
