A property owner sues insurer for breach of contract due to hurricane damage

ORLANDO — A property owner is suing Liberty Mutual Fire Insurance Company, citing alleged refusal to apply payments due to hurricane damage.

Alfredo Sainz filed a complaint on May 14 in the 9th Judicial Circuit Court of Florida-Orange County against Liberty Mutual Fire Insurance Company alleging that the defendant refuses to honor its contractual obligations and pay for the covered loss.

According to the complaint, the plaintiff alleges that on Sept. 10, 2017, his property at 5421 Arpana Drive suffered a direct physical loss due to interior water damage caused by Hurricane Irma, while the policy was in full force and effect, and all conditions precedent were performed and met. 

However, Sainz claims, despite defendant acknowledging the claim and inspecting the property, defendant allegedly rejected the total amount of damages. As a result, he continues to suffer damages and incur substantial expenses. 

The plaintiff holds Liberty Mutual Fire Insurance Company responsible because the defendant allegedly refuses to honor its contractual obligations and pay for the covered loss.

The plaintiff requests a trial by jury and seeks damages greater than the sum of $15,000.00, exclusive of interest, costs and attorney’s fees, and such further relief the court may deem appropriate. He is represented by Hunter Patterson and Alicia Perez of Strems Law Firm in Winter Park.
