Customer claims car manufacturer and dealer breached warranty

CLEARWATER — A customer is suing General Motors LLC and MK Automotive Inc. d/b/a New Wave Auto Sales, manufacturer and dealer, citing alleged breach of implied and express warranty and violation of the Magnuson-Moss Warranty Act

Tevin Mitchell Quevedo filed a complaint on May 9 in the Pinellas Circuit Court against the defendants alleging that they obtained profit through distribution of a substandard product.

According to the complaint, the plaintiff alleges that on Jan. 27, 2018, he was caused to lose faith and confidence in the vehicle he purchased from the defendants and suffered the loss of monies and use of property as a result of the unlawful conduct of the defendants in manufacturing and selling a defective vehicle and their failure to effectively repair the vehicle when necessary. 

The plaintiff holds General Motors LLC and MK Automotive Inc. d/b/a New Wave Auto Sales responsible because the defendants allegedly failed to adequately investigate and repair the defects within a reasonable time and/or number of attempts, and failed to conform the product to the written and express warranties.

The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory, incidental, or consequential damages, attorney's fees, costs, interest, and other relief the court deems just. He is represented by Aldo Bolliger of Bolliger Law Group PLLC in Tampa.
