ORLANDO — Property owners are suing People's Trust Insurance Company, an insurer, citing alleged breach of contract.
Luis and Alba Martinez filed a complaint on May 9 in the Orange Circuit Court against People's Trust Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that on Sept. 9, 2017, Luis and Alba Martinez's dwelling sustained damages during the policy period, and while they have notified defendant of the covered loss to their property and complied with all conditions precedent to recover under the policy, the defendant has failed or refused to fully perform under the policy.
The plaintiffs hold People's Trust Insurance Company responsible because the defendant allegedly breached the insurance contract by failing fully pay for all of plaintiffs’ losses, and obligating plaintiffs to retain the services of an attorney to bring action.
The plaintiffs request a trial by jury and seek judgment against defendant for plaintiffs’ losses with interest on any overdue payments, attorney's fees and costs. They are represented by Eric Deming of Morgan & Morgan PA in Orlando.
