Widow alleges negligence from nursing home, medical providers caused husband's death

CLEARWATER — A widow is suing a Palm Harbor nursing care facility, alleging negligence in her husband's wrongful death.

Carol Ann Knizek, as personal representative of Hans Erwin Knizek, filed a complaint May 8 in Pinellas County Circuit Court against Manor Care of Palm Harbor LLC, doing business as Manorcare Health Services - Palm Harbor, HCR III Healthcare, LLC and Heartland Employment Services LLC  alleging they breached their duty in the care and treatment of a patient, resulting in wrongful death.

According to the complaint, between Dec. 22, 2016-March 22, 2017, the plaintiff's husband, Hans Erwin Knizek was a resident and patient of the defendants at Manor Care Health Services Palm Harbog. The suit says his condition worsened upon his stay at the facility and he died March 22, 2017. Carol Ann Knizek alleges that upon her husband's death, the family has suffered mental anguish, emotional pain, suffering, loss of companionship, guidance and support, plus medical, hospital and funeral expenses. 

The plaintiff alleges the defendants failed to provide proper staffing, adequate treatment and professional care to its residents and patients, resulting in suffering and wrongful death.

Carol Ann Knizek seeks trial by jury, damages exceeding $15,000, plus court costs, interests, attorney fees and all other just and proper relief. She is represented by attorney Anthony T. Martino of Clark & Martino PA in Tampa.
