CLEARWATER — An invitee is suing Kozuba & Sons Distillery Inc. and 1960 5th Avenue S LLC, business operators, citing alleged negligence.
Debra Bebell filed a complaint on May 7 in the Pinellas Circuit Court against Kozuba & Sons Distillery Inc. and 1960 5th Avenue S LLC alleging that the business operators failed to provide a safe environment for its business invitees.
According to the complaint, the plaintiff alleges that on Nov. 18, 2017, she was lawfully at the distillery owned by the defendants when she tripped and fell over a support leg of a corn hole board that was placed carelessly on the floor by an employee of the defendants, causing her to suffer fractures on both wrists, pain and suffering, disability, mental anguish, loss of earnings and/or aggravation of a pre-existing condition.
The plaintiff holds Kozuba & Sons Distillery Inc. and 1960 5th Avenue S LLC responsible because the defendant allegedly failed to provide proper lighting to prevent accidents, failed to properly inspect and maintain the property for hazards and failed to warn plaintiff of the dangerous condition.
The plaintiff requests a trial by jury and seeks judgment against defendants for damages exceeding $15,000 for each count, and such other relief as the Court deems just. She is represented by Paul R. Cavonis and Joseph M. Murphy of Deloach, Hofstra & Cavonis PA in Seminole.
