Orlando homeowner alleges insurance carrier failed to cover hurricane damage

Insurance 03

ORLANDO — An Orlando homeowner is suing an insurance carrier, alleging breach of contract.

Dean Marco filed a complaint May 9 in Orange County Circuit Court against Tower Hill Signature Insurance Company, alleging failure to pay for property damage caused by a hurricane.

According to the complaint, on Sept. 9, 2017, while his property's insurance was in full force and effect, Marco's home at 9202 Ridge Pine Trail, Orlando, sustained a covered loss as a result of Hurricane Irma. The suit says, Tower Hill Signature, however has never tendered any of the insurance benefits from its own damage estimate.

The plaintiff alleges Tower Hill Signature Insurance has failed and/or refused to tender all owed insurance proceeds, and forced Marco to hire a legal counsel.

Marco seeks trial by jury, compensatory and consequential damages of more than $15,000, pre-judgment and post-judgment interest, costs of action, attorney fees and all other relief the court deems just. He is represented by attorney David J. Pettinato of Merlin Law Group PA in Tampa.
