ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.
Eva Marlyn Navas filed a complaint May 7 in Orange County Circuit Court against American Strategic Insurance Corporation, alleging failure to provide coverage after a hurricane.
According to the complaint, on Sept. 11, 2017, Navas suffered a direct physical loss to her property at 519 Flower Fields Lane, Orlando, due to wind-driven rains during Hurricane Irma, a covered peril. The suit says although American Strategic acknowledged coverage of the loss, it has rejected the total amount of damages.
The plaintiff alleges American Strategic Insurance has refused to honor its contractual obligations and pay for the covered loss, and obligated Navas to retain the services of an attorney.
Navas seeks trial by jury, judgment of more than $15,000, plus costs, prejudgment interest and attorney fees. She is represented by attorneys Hunter Patterson and Alicia Perez of Strems Law Firm in Winter Park.
