Orlando homeowner alleges insurer failed to pay $35,000 for hurricane damage

ORLANDO — An Orlando resident is suing an insurance company, alleging refusal to apply payments for hurricane damage.

Michelle Class filed a complaint May 7 in Orange County Circuit Court against Castle Key Insurance Company, alleging failure to honor contractual obligations and pay more than $35,000 for a homeowner's insurance policy.

According to the complaint, on Sept. 11, 2017, Class' home at 12956 Nebraska Woods Court, Orlando, was hit by Hurricane Irma. The suit says Class suffered a covered loss and substantial damages totaling $35,590.24 while the insurance policy is in full force and effect. 

Class says Castle Key was timely notified and she has performed all conditions precedent to recover under the policy. The plaintiff alleges Castle Key Insurance has failed to timely evaluate the claim and continues to refuse to pay the full amount of the policy benefits, despite having received and processed Class' claim.

Class seeks trial by jury, damages of $35,590.24, exclusive of costs, interest, attorney fees and all other relief the court deems just and proper. She is represented by attorney Michael S. Takiff of Militzok & Levy PA in Hollywood.
