ORLANDO — A husband and wife are suing American Integrity Insurance Company of Florida, an insurer, citing alleged breach of contract.
Cindy and Eric Hennig filed a complaint on May 7 in the Orange Circuit Court against American Integrity Insurance Company of Florida alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that, on June 17, 2017, Cindy and Eric Hennig sustained economic damages, including damaged property and repair costs, when their property was substantially damaged by a covered peril while insurance policy was in full force and effect. Although the plaintiffs complied with all conditions precedent to entitle them to recover under the policy, the defendant refused to reimburse them adequately for the damages.
The plaintiffs hold American Integrity Insurance Company of Florida responsible because the defendant allegedly failed to pay full value for roofing and/or construction services to plaintiff and obligated plaintiffs to retain and pay for an attorney.
The plaintiffs request a trial by jury and seek judgment against defendant for all unpaid and overdue insurance benefits with interest, costs, attorney's fees, and for all other remedies the Court sees fit to grant. They are represented by Francisco E. Serrano of Cohen Law Group in Maitland.
