Consumers seek damages from Safe Step Walk-In Tub over allegations tub installed was too small

CLEARWATER – A woman alleges that walk-in tub sold to her was too small and that she became stuck when using it.

Paul Sotirakis, as attorney-in-fact for Betty Sotirakis, filed a complaint on May 3 in the 6th Judicial Circuit Court - Pinellas County against Safe Step Walk-In Tub Co. and Timothy Talley alleging negligence and other counts.

According to the complaint, the plaintiffs allege that in July 26, 2017, they executed a contract with Safe Step for the purchase, installation and warranty of a walk-in tub designed to accommodate persons with physical disabilities and difficulty with mobility. They allege they met and discussed with Talley about the specifications prior to the execution of the contract. 

However, plaintiffs allege the product sold to them was inappropriate for Betty's size and specifications and she became stuck in the tub on its first use had to be extracted by paramedics. 

The plaintiffs hold Safe Step Walk-In Tub Co. and Talley responsible because the defendants allegedly breached their duty of care.

The plaintiffs demand a trial by jury and seek damages of more than $15,000 plus interests, costs, attorney's fees and other relief the court may deem just and proper. They are represented by Stephen A. Barnes and John V. Trujillo Jr. of Barnes Trial Group in Tampa.
