Customer accuses St. Petersburg bar of negligence

CLEARWATER — A customer is suing a St. Petersburg bar, alleging negligence in that insufficient measures were taken to prevent injuries.

CLEARWATER — A customer is suing a St. Petersburg bar, alleging negligence in that insufficient measures were taken to prevent injuries.

Janet Schack filed a complaint May 1 in Pinellas County Circuit Court against Undertow Beach Bar - St. Pete Beach Inc., alleging failure to maintain its property in a reasonably safe condition.

According to the complaint, on Nov. 14, 2017, Schack was at the Undertow Beach Bar, 3850 Gulf Blvd., St. Petersburg. The suit says Schack tripped on the vegetation that protruded on the sidewalk where she was walking. Schack says she sustained bodily injuries resulting in pain, suffering, disability, disfigurement, mental anguish, inconvenience, expense of hospitalization, medical and nursing care and treatment, loss of earnings and aggravation of a previously existing condition. 

Schack says the dangerous condition was known to the defendant. 

The plaintiff alleges Undertow Beach Bar - St. Pete Beach negligently maintained its property by allowing vegetation in the front to be overgrown and encroach on the sidewalk, making the area hazardous to pedestrians and visitors. The suit says the defendant and breached its duty by failing to warn customers of the existence of the dangerous and defective condition.

Schack seeks trial by jury, damages that exceed $15,000, excluding interests, costs, attorney fees and all other relief the court deems just and proper. She is represented by attorney Austin J. Grinder of The Ruth Law Team in St. Petersburg.
