Pinellas County motorist accuses another driver, insurer of negligence, breach of contract

CLEARWATER — A Pinellas County motorist is suing another vehicle driver and an insurance company, alleging negligence and breach of contract.

Brian Lee Johnson filed a complaint April 30 in Pinellas County Circuit Court against Ivan Mangual and Ohio Security Insurance Company, alleging they failed to pay insurance for an underinsured/uninsured motorist's coverage.

According to the complaint,on Aug. 22, 2016, Johnson was driving his 1998 Chevrolet near Park Boulevard and the intersection with of Belcher Road. The suit says he was struck by the 2009 Volkswagen driven by Ivan Mangua. Johnson says the crash caused him to suffer bodily injuries and incur medical expenses. 

At the time of the accident, the suit says, Johnson's vehicle was insured for automobile liability insurance, which included coverage for underinsured/uninsured motorist's coverage with Ohio Security Insurance Company and he has complied with all conditions precedent to the accident. 

The plaintiff alleges Mangual failed to exercise reasonable care while driving and Ohio Security Insurance breached its duty to pay insurance for underinsured/uninsured motorist's coverage.

Johnson seeks trial by jury, monetary damages that exceed $15,000, excluding costs, interests, attorney fees and all other relief the court deems appropriate. He is represented by attorney David A. Papa of Papa & Gipe PA in Clearwater.
