Tenant alleges property owner's negligence led to illness

CLEARWATER — A tenant is suing a Largo property owner, alleging negligence because insufficient measures were taken to prevent injuries and illness.

CLEARWATER — A tenant is suing a Largo property owner, alleging negligence because insufficient measures were taken to prevent injuries and illness.

Rebecca Vaughn filed a complaint April 30 in Pinellas County Circuit Court against Golf Terrace Investment Company, alleging failure to comply with all applicable building, housing and health codes by failing to properly maintain and repair the property.

According to the complaint, between December 2013 and June 2014, when Vaughn lived at 703 E. Bay Derive, Apartment B20, Largo, she noticed molds in multiple locations, and water leaks in her apartment unit and notified the defendant. 

Vaughn says she began experiencing physical symptoms including hoarseness, painful swallowing, blurred vision, eye pain, facial pain, seizures, hives and excessive fatigue. As a result, Vaughn says she has suffered from chronic exposure to mold, which prompted her to seek medical attention and incur significant costs.

The plaintiff alleges Golf Terrace Investment breached its duty by failing to comply with all applicable building, housing and health codes, including, failing to properly repair the continuous leak and resulting water damage, and renting a residential property to tenants that was unfit and dangerous for human habitation.

Vaughn seeks trial by jury, damages in excess of $15,000, exclusive of interest, fees, costs and all other relief the court deems just and proper. She is represented by attorneys Satin Gandhi, W. Chase Carpenter and Cindy L. Cumberbatch of Carpenter Gandhi PLLC in Tampa.
