Customer alleges frozen yogurt stand's negligence caused him to be hit by car

FORT LAUDERDALE — A Georgia man is suing the business owners of a Fort Lauderdale frozen yogurt stand, alleging premises liability and negligence.

Stephen Troiano of Paulding County, Georgia, filed a complaint April 30 in Broward Circuit Court against 2601 North Dixie LLC, Tee-Hee Corp., doing business as Menchie's Frozen Yogurt, Enterprise Leasing Company of Florida LLC and Frederick Johnson, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on July 24, 2017, Troiano was sitting on a table in the designated outdoor seating area at Menchie's in Fort Lauderdale. The suit says Johnson drove over the sidewalk curb and plowed into Troiano, pinning him to Menchie's outside wall and causing multiple fractures and other bodily injuries, pain and suffering, disability, loss of earnings and medical expenses. 

The plaintiff alleges the defendants failed to provide adequate protective barriers to patrons using the outdoor seating area, and failed to ensure that Johnson was capable of safely operating the vehicle.

Troiano seeks trial by jury, damages of more than $15,000, plus all other relief the court deems just. He is represented by attorneys John Marc Tamayo, Hank Campbell and Hannah Dantzler-Fleming of Campbell Trohn Tamayo & Aranda in Lakeland.
