Customer alleges McDonald's restaurant owner's negligence caused injuries

CLEARWATER — A Pinellas County woman is suing the operator of a McDonald's restaurant in St. Petersburg, alleging negligence led to injuries to the plaintiff.

Charlene D. Davis filed a complaint April 25 in Pinellas Circuit Court against JTS Enterprises of Tampa Limited, alleging failure to maintain its premises in a safe condition.

According to the complaint, on Aug. 4, 2017, Davis was lawfully on the premises of the defendant at 1661 Fourth St. S., St. Petersburg. The suit says Davis lost her balance and fell due to an oily substance in the parking lot that had accumulated from vehicles using the lot. Davis says the fall caused her to suffer from bodily injury and resulting pain, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, medical expenses, loss of earnings and loss of the ability to earn income. 

The plaintiff alleges JTS Enterprises of Tampa Limited, owners of the restaurant space, failed to use due care in providing a safe environment for users of the parking lot and failed to inspect the parking lot.

Davis seeks trial by jury, damages of more than $15,000, plus court costs. She is represented by attorneys Donald C. Anderson Jr. and Creighton Shafer of Anderson & Shafer in St. Petersburg and by Joey Oquist of St. Petersburg.
