Dunedin homeowner alleges insurer failed to cover wind damage

CLEARWATER — A Dunedin resident is suing an insurer, alleging breach of contract.

Michael Vieli filed a complaint April 26 in Pinellas Circuit Court against Omega Insurance Company, alleging the insurer failed to cover wind damage associated with a hurricane. 

According to the complaint, on Sept. 10, 2017, Vieli's insured dwelling at 1191 Robmar Road sustained a covered loss from windstorm damage associated with Hurricane Irma. Even though Vieli notified Omega of the loss in a timely manner and the defendant has already assigned a claim, the suit says, the defendant has refused to pay for all of the plaintiff's losses. 

The plaintiff alleges Omega Insurance has breached the insurance contract and obligated Vieli to retain the services of an attorney to bring legal action.

Vieli seeks trial by jury, judgment for all covered losses of more than $15,000, plus interest on any overdue payments, attorney fees and court costs. He is represented by attorney Jeffrey Constantinos of Morgan & Morgan PA in Tampa.
