State Farm alleges vehicle owner, operator owe $27,000

FORT LAUDERDALE — State Farm and an insured policy holder are suing a vehicle owner and operator, alleging breach of duty.

State Farm Mutual Automobile Insurance Company and Peter Sheridan, individually, filed a complaint April 23, in Broward County Circuit Court against Alexander Russell and Edna Douglas Batchelor, alleging the defendants breached the terms of the policy to pay subrogation rights to an insurance company.

According to the complaint, on May 12, 2017, Sheridan's vehicle was struck by Edna Douglas' vehicle that was being operated by Alexander Russell near 900 NE 4th Ave. Hallendale. State Farm alleges it has paid Sheridan benefits of $26,619.60 but it has failed to receive its subrogated rights from the defendants. 

The plaintiffs allege Russell and Batchelor entrusted and operated a vehicle in a negligent manner so as to cause a collision with another vehicle and have failed to pay insurance damages of $26,619.60, plus $500 for deductible.

The plaintiffs seek trial by jury, judgment of $27,119.60, plus interest and court costs. They are represented by the legal team of Lotane & Associates PA in Cocoa.
