Student suing educational institution after assault

ORLANDO — A student is suing an educational institution, citing alleged negligence and breached of duty.

James Henderson Jr. filed a complaint April 23 in 9th Judicial Circuit Court of Florida-Orange County against Lake Highland Preparatory School, Inc., alleging that it breached its duty to protect its students from harm.

According to the complaint, the plaintiff alleges that on Aug. 24, 2014, he was physically and violently hit by Harold Wise, who was on the school's premises under its auspices and with its permission.Thereby, the school had a duty to protect plaintiff Henderson from harm. 

As a direct proximate result, Henderson claims, he suffered bodily injuries, emotional pain and mental anguish. 

The plaintiff holds Lake Highland Preparatory School responsible because it allegedly failed in its responsibility to protect students from harm and physical injuries.

The plaintiff requests a trial by jury and seeks judgement for damages in an amount that exceeds $15,000 and any other relief the Court deems just and proper. He is represented by Frank Kruppenbacher and Vincent M. D’Assaro of Morgan & Morgan PA in Orlando.
