ORLANDO – Owners of a Winter Garden property allege their insurance company has failed or refused to pay all of the bills associated with property loss.
Jay and Fotene Rooth filed a complaint on April 20 in the 9th Judicial Circuit Court of Florida - Orange County against American Integrity Insurance Co. of Florida alleging breach of contract.
According to the complaint, the plaintiffs allege that their dwelling suffered a physical loss that requires reconstruction services to restore the home back into its pre-loss condition. The plaintiffs claim they timely notified the defendant of the loss and complied with all conditions precedent to entitle them to recover under the policy.
However, despite acknowledging their claim, the defendant allegedly refused to pay the full value for the services needed to repair the home.
The plaintiffs seek judgment for all amounts needed to repair the property, including any unpaid bills or additional services needed, with interest on any overdue payments, plus costs and attorney fees. They are represented by Imran Malik of Malik Law PA in Maitland.
