Customer alleges Wal-Mart negligence led to fall, injuries

ORLANDO — An Orange County woman is suing an Orlando Wal-Mart, alleging negligence led to injuries for the plaintiff.

Judith Rosa filed a complaint April 23 in Orange County Circuit Court against Wal-Mart Stores East LP ,alleging failure to provide a safe environment for its business invitees.

According to the complaint, on Sept. 12, 2016, Rosa was walking toward the exit of the WalMart store, 11250 E. Colonial Drive, Orlando. The suit says Rosa sustained injuries when she slipped and fell due to water that was allowed to remain on the floor of its store.  

As a result, Rosa says, she sustained injuries in and about her body and extremities, resulting in pain and suffering, disability, scarring, mental anguish, medical expenses, loss of earnings and aggravation ofa  previous existing condition. 

The plaintiff alleges Wal-Mart Stores East failed to inspect or adequately warn Rosa of the danger of the water on its flooring, and failed to adequately correct the unreasonably dangerous condition.

Rosa seeks trial by jury, damages that exceed $15,000, exclusive of interest, court costs, attorney fees and all other relief the court deems proper She is represented by attorney W. Clay Mitchell Jr. of Morgan & Morgan PA in Orlando.
