Customer alleges outdoor sign company failed to deliver product

CLEARWATER — A North Carolina customer is suing a Pinellas County outdoor sign business, alleging breach of contract and failure to deliver a purchased product.

Darrell Swanger of Haywood County, North Carolina, filed a complaint April 18 in Pinellas County Circuit Court against Suncoast Led Displays LLC, alleging the defendant failed to deliver the sign identified in the contract.

According to the complaint, on May 25, 2017, Swanger entered into a sales contract where Suncoast agreed to create an "Outdoor V-Series" sign. Swanger says he performed all his obligations required by paying a deposit of $5,975 and the full amount of 6.375 but has experience numerous delay in the delivery of the sign. 

The suit says Swanger has sent written notice, requesting cancellation of the contract and a full refund of the money he paid for unrendered services. 

The plaintiff alleges Suncoast Led Displays made false representations that delivery would take place during a reasonable time in order to induce Swanger to pay the full price for the product.

Swanger seeks trial by jury, monetary and treble damages for fraudulent misrepresentation, attorney fees and all other relief the court deems just and proper. He is represented by attorney Marshall R. Berner of Four Rivers Law Firm PLLC in Tampa.
