FORT LAUDERDALE — Two Pembroke Pines owners are suing an insurer, alleging breach of contract.
Ronald and Theresa Sammario filed a complaint April 19 in Broward Circuit Court against Citizens Property Insurance Corporation, alleging the insurer failed to pay for a covered loss.
According to the complaint, on Sept. 10, 2017, while Ronald and Theresa Sammario's insurance policy was in full force and effect, their property at 19321 NW Sixth St., Pembroke Pines, sustained a covered loss as a result of wind damage from Hurricane Irma. However, the suit says, Citizens Property concluded the total covered loss was less than the plaintiffs'' deductible.
The plaintiffs allege Citizens Property Insurance failed to acknowledge or deny that further payment would be forthcoming, failed to make any further payment of insurance proceeds and obligated the Sammarios to retain an attorney for legal action.
The Sammarios seek trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorney Antonio Jimenez of Diverse Legal Solutions in Miramar.
