Parents allege falling dresser injured child at Madeira Beach resort

CLEARWATER — Two parents of a minor child are suing a Madeira Beach resort, alleging negligence led to injuries for the child.

Stanley Midura and Audre Midura, individually and as parents and natural guardians of Tyler Midura, a minor, filed a complaint April 18 in Pinellas County Circuit Court against All Seasons Vacation Resort Condominium Association Inc., alleging failure to use reasonable care for the safety of its guests.

According to the complaint, on Aug. 12, 2016, Tyler Midura and his parents were guests and lawfully on the defendant's All Seasons Vacation Resort in Madeira Beach when a dresser in Room 307 fell on top of the minor plaintiff, causing injuries and damages. 

As a result of the dangerous and unsafe condition, the suit says, Tyler Midura experienced severe pain and suffering and physical impairment that made his parents liable for medical expenses. 

The plaintiffs allege All Seasons Vacation Resort Condominium Association failed to remedy the dangerous and unsafe condition and/or failed to warn the minor plaintiff or his parents of the dangerous and unsafe condition.

The Miduras seek trial by jury, damages in excess of $15,000, plus costs of suit. They are represented by attorney Joseph W. Chambers of Chambers Law Group, PA in St. Petersburg.
