Parkland couple alleges insurer has failed to pay for hurricane damage

FORT LAUDERDALE — A Parkland couple is suing an insurer, alleging it owes more than $15,000 for breach of contract.

Robert and Jan Warmund filed a complaint April 18 in Orange County Circuit Court against USAA Casualty Insurance Company, alleging the defendant failed to pay for property damage caused by a hurricane. 

According to the complaint, on Sept. 10, 2017, Robert and Jan Warmund suffered covered damages to their insured property at 6503 NW 105th Terrace, Parkland, due to Hurricane Irma. However, the suit says, the defendant maintains the value of the loss, according to its calculation, is below the plaintiffs' applicable deductible. 

The plaintiffs allege USAA Casualty Insurance has failed to provide the necessary reimbursement for covered losses, failed to timely evaluate the damages, and obligated the plaintiffs to retain an attorney to prosecute a legal action.

The Warmunds seek trial by jury, damages in excess of $15,000, plus costs, interest, attorney fees and all other relief the court deems proper. They are represented by attorney William S. Blatt of Fort Lauderdale.
