Former employee alleges Orlando retirement facility failed to pay proper wages

ORLANDO — A former employee is suing an Orlando retirement community, alleging violation of the Fair Labor Standards Act (FLSA).

Cynthia Gale filed a complaint April 19 in Orange County Circuit Court against Presbyterian Retirement Communities Inc., doing business as Westminster Towers, alleging the defendant failed to provide employees their proper wages, benefits and incentives.

According to the complaint, Gale began working at Westminster Towers in February 2014 as a staffing coordinator, often working more than 40 hours per week. The suit says Gale has suffered a loss of earnings, for routinely working additional hours in excess of 40 per week, but has not been compensated at the statutory rate of one and a half her regular rate of pay as required the FLSA.. 

The plaintiff alleges Westminster Towers has required her to work significant hours off the clock with no additional compensation, failed to provide an accurate record of Gale's hours worked and failed to compensate her of overtime wages.

Gale seeks trial by jury, payment of all overtime hours, liquidated damages, attorney fees, costs incurred and all further relief the court deems just. She is represented by attorney Carlos V. Leach of The Leach Firm PA in Winter Park.
