ORLANDO — A New York customer is suing an Orlando spa and wellness center, alleging breach of duty and negligence in burning the plaintiff's back.
Miguel Arias of the Bronx, New York, filed a complaint April 16 in Orange County Circuit Court against Jade Spa Orlando Inc., alleging the defendant breached its duty in performing stone massages to customers, causing injuries.
According to the complaint, on Sept. 6, 2017, Arias' back was burned while he was receiving hot stone messages from a Jade Spa employee. Arias says the defendant had possession and control of the “hot stones” and equipment used for massages in the spa, and was responsible for the conduct of its employees who were administering “hot stone” massages.
As a result, Arias says he sustained injury in and about his body and extremities, resulting in pain and suffering and the expense of hospitalization, medical and nursing care.
The plaintiff alleges Jade Spa Orlando failed to train employees who performed the stone massages, failed to supervise the employee performing the procedure and failed to inspect or adequately inspect the stone massage tools and equipment on the premises to determine whether a dangerous condition existed before providing massages.
Arias seeks trial by jury, damages in excess of $15,000, plus interest and court costs. He is represented by attorney Lawrence Gonzalez II of Morgan & Morgan PA in Orlando.
