Rio Stone Group driver alleges he was terminated over complaints regarding overtime pay

ORLANDO – A Seminole County man alleges he was terminated shortly after he complained about not receiving the correct rate for overtime pay.

Tomas Quiles filed a complaint on April 18 in the 9th Judicial Circuit Court of Florida - Orange County against Rio Stone Group Inc. over alleged violation of the Fair Labor Standards Act and unlawful retaliation.

According to the complaint, Quiles alleges that on May 2, 2017, he was hired as a non-exempt local delivery employee by defendant and worked more than 40 hours within a workweek. He alleges he voiced his objections for allegedly not being compensated at the correct rate for his overtime work and shortly afterward his employment was terminated April 12.

The plaintiff holds Rio Stone Group Inc. responsible because the defendant allegedly failed to compensate a non-exempt employee at the statutory rate of one-and-one-half times the regular rate of pay for the hours worked in excess of 40 hours per week and terminated him in retaliation over his complaints.

The plaintiff requests a trial by jury and seeks judgment for actual and compensatory damages, including front pay and back pay; liquidated damages; as well as costs and attorneys’ fees; declaratory and injunctive relief and such other relief deemed proper by the court.
