Pinellas Park couple accuses insurer of contract breach

CLEARWATER — A Pinellas Park couple is suing an insurer, alleging breach of an insurance contract.

Jessica and Robert Breton filed a complaint April 10 in Pinellas Circuit Court against Southern Oak Insurance Company, alleging failure to cover an insured loss. 

According to the complaint, on July 25, 2017, the Bretons suffered damages to their property on 66th Street in Pinellas Park due to a covered peril. The suit says Southern Oak has failed and refuses to admit coverage and pay the plaintiffs the benefits to which they are entitled for the loss. 

The plaintiffs allege Southern Oak Insurance has failed to acknowledge the covered loss, failed to pay the benefits due and owing under the policy and forced the plaintiff to retain the services of an attorney.

The Bretons seeks trial by jury, damages of more than $15,000, interest, court costs, expert fees, attorney fees and all further relief the court deems just. They are represented by attorneys Dean Makris and Matthew K. Mullinax of Makris & Mullinax PA in New Port Richey.
