CLEARWATER — A Florida man is suing the Pinellas County sheriff, alleging negligence caused an injury to the plaintiff in the county jail.
Timothy J. Tirado filed a complaint April 10 in Pinellas Circuit Court against Pinellas Count Sheriff Bob Gualtieri, alleging the defendant failed to use due care to maintain the Pinellas County Jail in a safe condition.
According to the complaint, on May 2, 2016, Tirado was pulling a juice cart back to the kitchen area at the Pinellas County Jail when an employee of the sheriff's office closed a gate on Tirado's right thumb. The suit says Tirado sustained bodily injury, pain and suffering, scarring, mental anguish, disfigurement, loss of earnings, and incurred medical expenses.
The plaintiff alleges Gualtieri failed to warn Tirado of the dangerous condition, failed to maintain the jail in a reasonably safe condition, and failed to follow proper safety measures and utilize precautionary devices to prevent injury.
Tirado seeks trial by jury, judgment of more than $15,000, plus costs and interest on all liquidated, pecuniary and out-of-pocket damages. He is represented by attorney Bryan D. Caulfield of Perenich, Caulfield, Avril & Noyes PA in Clearwater.
