Volunteer alleges county parks department's negligence led to severe finger injury

ORLANDO — A volunteer is suing Orange County Parks and Recreation, doing business as Kelly Park (Rock Springs), alleging negligence led to a severe finger injury for the plaintiff.

Ezequial M. Tiscareno filed a complaint April 10, in the Orange Circuit Court against Orange County Parks and Recreation d/b/a Kelly Park (Rock Springs) alleging that the park operator failed to follow applicable safety guidelines and regulations.

According to the complaint, on Jan. 12, 2016, Tiscareno was on defendant's Kelly Rock property in Apopka as a community service volunteer. The suit says Tiscareno was negligently assigned by the defendant's staff to operate a wood splitter without knowing if the plaintiff carries a license to operate such a equipment or machinery. As a result, Tiscareno says, he sustained a traumatic and debilitating injury to his right index finger, leading to suffering, disability, hospital expenses and loss of enjoyment of life. 

The plaintiff alleges Kelly Park (Rock Springs) failed to protect Tiscareno from any traumatic injuries and failed to provide adequate supervision to the plaintiff and all volunteers.

Tiscareno seeks trial by jury, damages, including costs of action, and all other relief the court deems just. He is represented by attorney Tiffany M. Faddis of Dan Newlin & Partners in Orlando.
