Orlando property owner alleges insurance company refuses to acknowledge coverage claim

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Monica Rodriguez Nunez filed a complaint April 10 in Orange County Circuit Court against Omega Insurance Company, alleging failure to honor its contractual obligation and pay for the unpaid damages to the insured property.

According to the complaint, on June 12, 2017, Nunez suffered a property loss at 913 Ocala Woods Lane,Orlando, due to water discharge in the kitchen resulting a from a faucet leak, a covered peril under Omega's policy. Nunez says Omega was given timely notice of the loss and it acknowledged receipt but has refused to properly investigate the claim to determine the actual amount of damages sustained. 

The plaintiff alleges Omega Insurance has failed to make a coverage determination of the loss and, therefore, has constructively denied the claim that has passed more than 90 days since it first received notice of the loss.

Nunez seeks trial by jury, damages of more than $15,000, plus costs, prejudgment interest and attorney fees. She is represented by attorneys Hunter Patterson and Alicia Perez of Strems Law Firm in Winter Park.
