Employee alleges Advanced Care Scripts procured additional consumer reports without permission

ORLANDO – A Kissimmee woman alleges that an Orlando-based pharmacy business obtains consumer reports from employees without authorization.

Tisha Manning filed a complaint on behalf of herself and on behalf of all others similarly situated on April 9 in the 9th Judicial Circuit Court of Orange County against Advanced Care Scripts Inc. alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff applied for a position with the defendant in November 2016 and was offered the position. She alleges in January 2018, she was told the defendant needed a "more extensive background check" and obtained another consumer report on her without additional authorization.

The plaintiffs hold Advanced Care Scripts Inc. responsible because the defendant allegedly obtained consumer reports for class members without proper authorization.

The plaintiffs request a trial by jury and seek judgment against defendant, determination that the case can proceed as a class action and designate class representative and counsel, declaratory relief, award, statutory damages, attorney's fees, costs and further relief that the Court may deem just. She is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
